This privacy policy ("Policy") describes how we collect, protect and use the personally identifiable information ("Personal Information") you ("User", "you" or "your") provided on the https://www.sportspickr.com website and any of its products or services (collectively, "Website" or "Services") owned and operated by Sportspickr LLC ("Sportspickr LLC", "us", "we" or "our"). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

Collection of personal information

We receive and store any information you knowingly provide to us when you create an account, publish content, make a purchase, fill any online forms on the Website. When required this information may include your email address, name, address, credit card information, or other Personal Information. You can choose not to provide us with certain information, but then you may not be able to take advantage of some of the Website's features.

Collection of non-personal information

When you visit the Website our servers automatically record information that your browser sends. This data may include information such as your computer's IP address, browser type and version, operating system type and version, language preferences or the webpage you were visiting before you came to our Website, pages of our Website that you visit, the time spent on those pages, information you search for on our Website, access times and dates, and other statistics.

Managing personal information

You are able to access, add to, update and delete certain Personal Information about you. The information you can view, update, and delete may change as the Website or Services change. When you update information, however, we may maintain a copy of the unrevised information in our records. We will retain your information for as long as your account is active or as needed to provide you Services. Some information may remain in our private records after your deletion of such information from your account. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

Your rights over your information

You can ask us to:

• give you a copy of the personal information we hold about you;
• correct anything that is wrong — most of it you can edit yourself in your account settings;
• delete your account and the personal information attached to it;
• stop sending you marketing email, which you can also do from the unsubscribe link in any of them;
• withdraw your consent to optional cookies, using the "Cookies" link in the footer.

To make any of these requests, please contact us. We will respond within 30 days. We may need to confirm your identity first, so that we do not act on a request made by someone else. We will not treat you differently for asking.

One limit is worth stating plainly. Sportspickr is a head-to-head game, so your picks and results form part of other players' league records. If you ask us to delete your account, we will remove the personal information attached to it — your name, email address, phone number, photo and payment details. Past picks, standings and matchup results stay, because they are also other players' history, but they will no longer identify you.

Use of collected information

Any of the information we collect from you may be used to personalize your experience; improve our website; improve customer service and respond to queries and emails of our customers; process transactions; send notification emails such as password reminders, updates, etc; run and operate our Website and Services. Non-personal information collected is used only to identify potential cases of abuse and establish statistical information regarding Website traffic and usage. This statistical information is not otherwise aggregated in such a way that would identify any particular user of the system.

Billing and payments

In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. Your full card number and security code are sent directly from your browser to our payment processor, Stripe, and are never received or stored by us. We store only the last four digits of the card, its expiry date, its billing postal code, and an identifier issued by Stripe that allows us to charge the card for a renewal without handling the card details again. We do not store your card security code at any point.

We keep a record of your transactions — the date, the amount, and the card identifiers described above — for seven years from the date of the transaction, for accounting, tax and dispute-resolution purposes. Other information is kept for as long as your account is active. All direct payment gateways adhere to the latest security standards as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. Sensitive and private data exchange happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

Children and minors

The Website is intended for adults. You must be at least 18 years old to create an account, and we do not knowingly collect personal information from anyone under 18. If you are under 18, please do not submit any personal information through our Website or Service. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing their children never to provide personal information through our Website or Service without their permission. If you have reason to believe that a minor has provided personal information to us through our Website or Service, please contact us and we will delete it.

Newsletters

We offer electronic newsletters to which you may voluntarily subscribe at any time. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting us. However you will continue to receive essential transactional emails.

Cookies

The Website uses "cookies" and similar browser storage to help personalize your online experience. A cookie is a small text file placed on your device by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer, and can only be read by a web server in the domain that issued the cookie to you.

We use two kinds:

• Essential — needed for the Website to work at all: keeping you signed in, remembering your league and timezone, and protecting forms against abuse. These cannot be switched off.
• Analytics — help us understand how the Website is used so we can improve it. These are optional.

When you first visit, we ask you to choose between "Accept All" and "Essential Only", and we remember your choice on that browser. Until you choose "Accept All", no analytics cookies are set. If you accept and later change your mind, we stop collecting and remove the analytics cookies already stored. You can change your choice at any time from the "Cookies" link in the footer, which reopens the banner. Declining the optional cookies does not restrict any feature of the Website.

You can also accept or decline cookies through your browser settings. Most browsers accept them automatically, but can be configured to decline them. If you decline essential cookies in your browser, you may not be able to sign in or use parts of the Website and Services.

Advertising

We do not display third-party advertising on the Website, and we do not share your information with advertisers or advertising networks. If this changes, we will update this Policy before we begin.

Service providers

We use a small number of third-party service providers to operate the Website, and share with each only the information it needs to do its job. They are:

• Stripe — payment processing. Receives your card details directly from your browser, together with your email address and billing postal code.
• Brevo — transactional and newsletter email. Receives your email address and the delivery status of messages we send you.
• OneSignal — push notifications. Receives a device identifier if you choose to enable notifications.
• Google reCAPTCHA — abuse and spam prevention on our forms. Receives device and interaction signals from your browser.
• Google Tag Manager and Google Analytics — usage analytics, subject to the cookie choices described below.

Each of these providers processes your information under its own privacy policy and its agreement with us. We do not sell your personal information.

Affiliates

We may disclose information about you to our affiliates for the purpose of being able to offer you related or additional products and services. Any information relating to you that we provide to our affiliates will be treated by those affiliates in accordance with the terms of this Privacy Policy.

However, no data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your personal information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and our Website cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.

Data breach

In the event we become aware that the security of the Website has been compromised or users Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. When we do we will send you an email.

Legal disclosure

We will disclose any information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. In the event we go through a business transition, such as a merger or acquisition by another company, or sale of all or a portion of its assets, your user account and personal data will likely be among the assets transferred.
